Fish & Associates specializes in intellectual property.  Our work is split about 50/40 between prosecution and litigation, with most of the prosecution work focusing on patents and trademarks.  The balance of the work deals with product and software licensing, work-for-hire agreements, ownership disputes, branding issues, intellectual property audits, trade secrets, confidentiality, unfair competition, and opinion work regarding patentability, infringement, validity, enforceability, and right-to-practice issues.

For a boutique firm we have a very large experience base.  At any given time we handle about 1500 foreign and domestic patent applications.  Our experience spans a broad range of disciplines, including software, Internet and computer science, mechanical engineering, medical devices, chemistry and pharmacology, biochemistry, biology and life sciences, and electrical engineering.

We handle all manner of patent prosecution, including patent interference, reexamination, reissue, and appellate proceedings before the USPTO.  We have strong working relationships with dozens of patent lawyers and agents in foreign countries, which we use to obtain patent protection for our clients.

The features that distinguish our firm most readily from others are: (1) our focus on strategizing in place of brute force efforts, and (2) our commitment to cost-effective representation.  We appreciate that legal expenses can significantly impact the bottom line, and we are always on the lookout for strategies that can produce superior results, while avoiding exorbitant charges.  Among other things we make extensive use of provisional filings, and we are one of the most experienced firms in the nation in filings of accelerated examinations.

Fish & Associates' Intellectual Property practice has gained regional and even national recognition.  Our largest client is based in Texas, and our next largest client is based in northern California.  Our founding partner, Robert Fish, has received considerable praise for his first two books, Cost-Effective Patenting and Strategic Patenting.   Mr. Fish was honored as one of the top attorneys in southern California by the Los Angeles magazine four years in a row.

Our trademark and copyright practices are relatively smaller than our patent and litigation practices, but here again we are second to none in providing high quality work at reasonable cost.  We have extensive experience in all areas and types of businesses that involve domain names, trade dress and unfair competition.

Our litigation practice has taken us to courts in five states, to the Ninth Circuit Court of Appeal, and several times to the Federal Circuit.  We have fought battles with all manner of opponents, from individuals to multinational companies.  We do take contingency work from time to time.
