Filing PCT Applications For Foreigners
A U.S. patent practitioner can file and prosecute PCT applications for any U.S.
citizen, resident, or company. This is not the case, however, for denizens of
other countries. One solution is for the applicant to grant some rights to a
U.S. individual or company, and then prosecute the application in the name of
that U.S. entity. Alternatively, the patent attorney or agent can list himself
as well as the foreign inventor or applicant on the transmittal form. That can
be done because an applicant on a PCT application doesn't necessarily have need
to have any rights in the application. Other suggestions are listed on the WIPO
