Methods of treating and diagnosing humans are generally unpatentable in New Zealand, except for ex vivo or in vitro processes. The proposed new patents bill (December 20, 2004 release) also prohibits patenting human beings and biological processes for their generation. New Zealand does accept Swiss type claims as in the EPO.
